1. The Service

Pre-Mortem.ai ("Bench") is an AI-powered analytical tool that generates decision risk analysis reports. Bench is an analytical tool only. It does not provide legal, financial, investment, or professional advisory services. All findings should be reviewed by the decision-maker and appropriate qualified advisors before action.

2. No Professional Advice

Bench reports are generated by artificial intelligence and are intended as decision-support tools only. They do not constitute legal advice, financial advice, investment recommendations, or professional consulting. You should not rely solely on a Bench report to make business decisions. Always consult qualified professionals for matters involving legal, financial, regulatory, or compliance obligations.

3. Accuracy and Limitations

Bench uses publicly available information, web research, and AI analysis to generate reports. While we strive for accuracy, we cannot guarantee that all information in a report is complete, current, or error-free. Research data is gathered from public sources and may contain inaccuracies. AI analysis reflects patterns and reasoning, not certainty. Historical comparables are pattern-matched, not predictive guarantees.

4. Liability Limitation

To the maximum extent permitted by law, Pre-Mortem.ai and its operators shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the service or reliance on any report. Our total liability is limited to the amount you paid for the specific report in question.

5. Payment and Refunds

Each report costs $449 USD, payable at the time of submission via Stripe. If Bench fails to deliver a report within 24 hours of payment, you are entitled to a full refund. Refund requests for delivered reports are evaluated on a case-by-case basis. Contact us within 7 days of delivery.

6. Confidentiality

If you accept the mutual NDA at checkout, your submission is governed by the terms of that agreement. Regardless of NDA status, we encrypt all briefs at rest, do not share your data with other customers, and do not use your data to train AI models.

7. Anonymized Data

With your consent (via NDA acceptance), we may retain anonymized structural patterns from your analysis to improve our service. Anonymized means all identifying information is removed. You may opt out at any time.

8. Intellectual Property

You own the decision brief you submit. We own the Bench analysis methodology, report format, and underlying technology. You receive a perpetual license to use your delivered report for any internal business purpose.

9. Acceptable Use

You agree not to use Bench to generate reports for illegal purposes, submit briefs containing malicious content, attempt to reverse-engineer the analysis methodology, or resell reports to third parties without written consent.

10. Modifications

We may update these terms at any time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of Wyoming, USA.
